PHISH TICKETING USER AGREEMENT

Welcome to Phish Ticketing ("Site") which provides its services to you subject to the following notices, terms and conditions ("Terms"). By using the Site, you agree to be bound by these Terms and to follow these Terms and all laws and regulations governing the Site. Phish Ticketing has the right to change these Terms at any time, which shall be effective as to any transaction made following the posting of the change on the site.

Lawful Use

You may visit, view and retain copies of this Site for your own personal use but may not duplicate, download, publish, modify or otherwise distribute information from the Site for any purpose other than to review event information and to purchase tickets for personal use, unless otherwise specifically authorized by Phish Ticketing. Phish Ticketing reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if Phish Ticketing believes the customers conduct violates applicable law or is harmful to the interests of Phish Ticketing.

Copyright

All content included on the Site, such as text, graphics, logos, button icons, images and software is the property of Phish Ticketing or its content suppliers and protected by U.S. and international copyright laws. The compilation of all content on this site is the exclusive property of Phish Ticketing and protected by U.S. and international copyright laws. The content and software of this site may be used as a shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on this site is strictly prohibited. All rights reserved

Disclaimer and Limitation of Liability

You expressly agree that use of the Site is at your own risk. Phish Ticketing does not promise that the Site will be error-free or uninterrupted, or that it will provide specific results from use of the Site content. The Site and content are delivered on an "as-available" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.

Except in jurisdictions where such provisions are restricted, in no event will Musictoday, Inc. be liable to you for any indirect, consequential, exemplary, incidental special or punitive damages, including lost profits, even if Phish Ticketing has been advised of the possibility of damages. The disclaimer of liability applies to any and all damages or injury from any cause, including without limitation damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

Your ticket is a revocable license which may be revoked at any time for any reason. The ticket holder voluntarily assumes all risk and danger incidental to the event for which the ticket is issued, whether occurring prior to, during, or subsequent to the actual event.

Sales and Refunds

  • All Sales Are Final. If the event is cancelled, rescheduled, or the venue is closed for any reason, you will be updated via email as soon as information is available. We will send an e-mail to the e-mail address provided by you in the ordering process (you must provide a valid e-mail address with your order). Before traveling to the show, please confirm the show with the venue.
  • For General Admission Tickets To Be Picked Up At Will-Call By Customer - Refunds due to cancellation or unforeseen facility closure will be issued in the amount of the face value of the tickets. In the event of cancellation or unforeseen facility closure, convenience and handling fees will not be refunded in order to cover the costs already incurred by Phish Ticketing
  • For General Admission or Reserved Seating Tickets Shipped to Customer - Refunds due to cancellation or unforeseen facility closure will be issued automatically in the amount of the face value of the tickets. In the event of cancellation or unforeseen facility closure, convenience, shipping and handling fees will not be refunded in order to cover the costs already incurred by Phish Ticketing.
  • Tickets for sale are intended for purchase by adults. By making a purchase on the site, you agree that you are at least 13 years of age.

Order Pickup and Delivery

  • Will-call orders will be held at the venue box office. You must bring your confirmation e-mail receipt, picture ID, and credit card used to purchase the tickets online. If you are unable to pick up your tickets at the venue because you do not have the credit card you used to purchase the tickets, we are unable to offer a refund for your ticket order.
  • Only the individual placing a will-call order may pick up the tickets ordered.
  • Shipped orders are usually sent approximately two weeks before the first show ordered. If any shipped orders are re-routed after they have been sent, there is an additional fee. Shipped orders cannot be delivered to PO Box addresses. Entering a PO Box address may cause a delay in delivering your tickets and/or extra shipping charges.

A FEW CHOICE WORDS ON SCALPING
  • Phish Tickets has a zero tolerance stance against scalping and insists that all patrons of our service abide by our policy stated below. Tickets made available through this site are intended only for fans that are actually planning on attending the shows requested. It is strictly prohibited to resell any tickets obtained through Phish Tickets for more than the purchase price. If you are found to be reselling, trading or brokering tickets that you purchased through our site for profit, Phish Tickets may at its discretion cancel your ticket order and all other pending orders in your name. This cancellation will result in a refund of the total price for the tickets minus a $7.00 per ticket processing fee and any shipping fees that have been incurred with respect to the order. We reserve the right to investigate all orders suspected to be in violation of this policy.

    We urge you not to purchase tickets through brokers or "scalpers." These tickets may be counterfeit in which case you will not only be overcharged but will also likely be denied entry into the show.

PHISH TICKETS TERMS & CONDITIONS


PLEASE READ ALL INFORMATION CAREFULLY!


  • This form serves as a request form only. Filling out this form does not guarantee that you will receive tickets - you are not actually purchasing anything at this time. All orders are subject to availability. No Refunds. No Exchanges.

  • All requests, regardless of when they are placed, are treated equally in the system. Ticket requests are placed in a random selection process, and there is a possibility that you may not receive any tickets or you may receive tickets for only one of the shows you requested. Only one request will be accepted per customer. If you wish to request tickets for more than one show, you must do so, all at once, in the same ticket request.

  • Our allotment of tickets for each show is limited, so we may not be able to fulfill every request that we receive. You will be notified of your ticket status and your seat assignments prior to the public on-sale date. All notifications will be sent via email to the email address you provide in your ticket request. If you receive tickets, all amounts due will then be charged to your credit card. Please be aware that our allotment includes a sampling of all seats in the house.

  • You will be charged a convenience fee for each ticket purchased. In addition, all tickets will be shipped within the continental US via UPS 2-Day Air, and you will be charged a $10.00 shipping fee per order. Tickets shipped outside the continental US will be shipped via UPS International Priority at a charge specific to the country to which tickets are being shipped.

  • Packages may not be sent to a PO Box, and ticket requests with incorrect or no shipping information will not be processed.
  • This transaction is safe. We use the secure socket layer (SSL) protocol, the industry standard for secure transactions. It encrypts all of your personal information including credit card number, name, and address, so that it cannot be read as the information travels over the Internet.

  • There is a limit of one ticket request per credit card. As a security measure, Phish Tickets will accept a unique credit card number for each ticket request. If you attempt to place additional ticket requests with the same credit card number, all requests will be rejected. In addition, we will be filtering out multiple ticket requests made by the same person at the same billing address using different credit cards. Attempts to make multiple ticket requests by the same cardholder at the same address may result in a low priority assignment or even rejection of your requests.

  • LivePhish.com audio downloads are available for pre-order for every show of the summer tour. You may select MP3 or FLAC audio file formats. Prior to the show, you will receive an email with instructions on how to complete your download at LivePhish.com. Please note: If you do not receive tickets to the show(s) you ordered via Phish Tickets, you will still be charged for the download(s). If you do receive tickets to the show(s) you ordered via Phish Tickets, your download pre-order will charged in a separate transaction than your tickets. If you do not elect to pre-order a download now, you will still have the opportunity to purchase the audio at LivePhish.com at a later date.

  • Once purchased, tickets cannot be exchanged, refunded or returned unless the event is cancelled or moved to another date. In the event of a cancellation of an event, only the face value of the ticket will be refunded. If the event is moved to another date, tickets will remain valid and refund requests will be accepted up until (and including) the revised date of the event. No duplicate tickets will be issued to replace lost tickets.

  • Internet Service Providers (ISP) have tightened their definitions of SPAM. As a result, your ISP might categorize an email confirmation from this site as potential spam and filter it into a "Bulk" folder or a predetermined "SPAM" folder you define. If you place a ticket request and do not receive your email confirmation in your Inbox, please check in these areas before contacting customer support. Read our help page for more information about how to adjust your "SPAM" filters.
  • To purchase tickets using our web ticketing, your browser must have 128-bit encryption. To check what encryption your browser supports, click on “Help” and then “About” in the navigation bar of your browser. A window will pop up indicating the encryption level supported. If your browser supports an encryption level lower than 128-bit, then upgrade your browser; most browsers allow you to upgrade for free.
